These Terms of Use (“Terms”) govern your use of the Nobody Checks On Men website and, when available, the NCOM mobile application (collectively, the “Services”).
The Services are provided by Nobody Checks On Men LLC (“NCOM,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to these Terms.
1. Purpose of NCOM
NCOM is designed to help people be more intentional about staying connected with the people they care about.
NCOM may provide reminders, suggestions, relationship-management tools, local notifications, and communication handoffs intended to help you remember when it may be worth reaching out.
NCOM does not communicate with other people on your behalf. You decide whether, when, and how to contact someone.
2. NCOM is not a medical or mental health service
NCOM is not a healthcare provider, mental health provider, counseling service, crisis service, or substitute for professional medical, psychological, psychiatric, or emergency care.
The Services are not designed to diagnose, treat, cure, or prevent any medical or mental health condition.
Any reflection prompts, reminders, or relationship-related suggestions are provided for general informational and personal-use purposes only.
If you or someone else may be in immediate danger or experiencing a medical or mental health emergency, contact local emergency services or an appropriate qualified professional.
3. Your responsibility
You are responsible for how you use NCOM and for any communications or interactions you choose to initiate.
NCOM does not guarantee that another person will respond to you, that contact will improve a relationship, or that any particular outcome will result from using the Services.
You are responsible for using good judgment and respecting the privacy, boundaries, and wishes of the people you contact.
4. Contacts and communication features
If you choose to use device Contacts with NCOM, you are responsible for ensuring that you have appropriate access to and use of that information.
NCOM may allow you to begin a text message, phone call, or supported video call using communication tools provided by your device or operating system.
Those communications are handled by the relevant device, carrier, platform, or third-party service. NCOM does not control their availability, delivery, quality, security, or terms.
Carrier charges, message rates, data charges, or other third-party fees may apply.
5. Notifications and reminders
NCOM may allow you to enable reminders or local notifications.
Notifications are provided as a convenience only. Delivery may depend on device settings, operating-system behavior, battery settings, permissions, and other factors outside NCOM’s control.
You should not rely on NCOM notifications for emergencies, safety-critical situations, medical needs, or any circumstance requiring guaranteed or time-sensitive delivery.
6. Privacy
Your use of the Services is also subject to our Privacy Policy.
NCOM is designed around data minimization and local storage of core relationship information. Please review the Privacy Policy for more information about how NCOM and the NCOM website handle information.
7. Acceptable use
You agree not to misuse the Services.
You may not use NCOM to:
harass, threaten, stalk, intimidate, or abuse another person;
violate another person’s privacy or legal rights;
impersonate another person or misrepresent your identity;
use contact information in a way that is unlawful or unauthorized;
attempt to interfere with, damage, reverse engineer, disrupt, or compromise the Services;
use the Services for unlawful, fraudulent, or malicious activity; or
use automated systems, scraping tools, or similar methods to access the Services in a manner that interferes with their operation.
We may restrict or discontinue access to the Services if we reasonably believe they are being misused.
8. Ownership and intellectual property
The NCOM name, Nobody Checks On Men name, logos, branding, designs, text, software, visual elements, and other original materials associated with the Services are owned by Nobody Checks On Men LLC or used with permission.
These Terms do not give you ownership of NCOM intellectual property.
You may use the Services for your personal use in accordance with these Terms.
You may not copy, reproduce, distribute, sell, modify, create derivative works from, or commercially exploit NCOM materials except as permitted by law or with our written permission.
9. Feedback
We welcome feedback, ideas, and suggestions about NCOM.
If you voluntarily provide feedback, you agree that we may use it to evaluate, improve, or develop NCOM without an obligation to compensate you.
This does not give NCOM ownership of your personal information or your relationships.
10. Third-party services
The Services may rely on or interact with third-party platforms or services, including operating systems, messaging tools, calling services, video-calling services, website hosting, spam-prevention services, or other technology providers.
Those third-party services are governed by their own terms, policies, and availability.
NCOM is not responsible for the acts, omissions, outages, privacy practices, or performance of third-party services.
11. Availability and changes
NCOM is currently in development and may change over time.
We may add, remove, modify, test, suspend, or discontinue features or parts of the Services.
We do not guarantee that the Services will always be available, uninterrupted, error-free, or compatible with every device or operating-system version.
12. No warranties
To the fullest extent permitted by law, the Services are provided “as is” and “as available.”
We make no guarantee that NCOM will meet every user’s needs, prevent missed communications, improve relationships, or produce any specific result.
To the fullest extent permitted by law, Nobody Checks On Men LLC disclaims warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions may not allow certain warranty disclaimers, so portions of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, Nobody Checks On Men LLC and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.
This includes, without limitation, damages arising from missed communications, relationship outcomes, device behavior, notification failures, third-party services, data loss, or inability to access the Services.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Nobody Checks On Men LLC from claims, damages, losses, liabilities, and expenses arising from your misuse of the Services, violation of these Terms, or violation of another person’s rights.
15. Termination
You may stop using NCOM at any time.
We may suspend or terminate access to the Services if reasonably necessary to protect the Services, our users, third parties, or our legal rights.
Sections of these Terms that by their nature should survive termination will continue to apply.
16. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any legal proceeding arising from these Terms or the Services will be subject to the jurisdiction of courts located in Missouri, unless applicable law provides otherwise.
17. Changes to these Terms
We may update these Terms as NCOM evolves.
When we make changes, we will post the updated Terms on the NCOM website and revise the effective date.
Your continued use of the Services after updated Terms become effective means you accept the revised Terms to the extent permitted by law.
